1. Who we are
feelit.ca is an online shop for experience gifts. It is operated by 2828468 ALBERTA INC., a corporation incorporated in Alberta, Canada, carrying on business as FeelIt (“FeelIt”, “we”, “us”). FeelIt sells every experience and every gift certificate on this site in its own name. When you buy, your contract is with us. Our business and mailing address is 3-1626 28 Ave SW, Calgary, AB T2T 1J4. You can reach us by email at [email protected]. All prices and refunds on this site are in Canadian dollars (CAD).
FEELIT™ is a trademark of 2828468 ALBERTA INC.
2. What you buy
FeelIt sells two things.
- A booking for yourself. You choose the experience, the date and time, and the number of people at checkout. Your seats are held from the moment you pay, and your confirmation email names the operator that will conduct the experience (section 3).
- A gift certificate. A certificate is FeelIt’s own promise to provide an experience up to the certificate’s face value. It is redeemable only at feelit.ca. No date is chosen when it is bought: the person holding it chooses the experience and the date when they are ready. A certificate always has a recipient — you can name yourself.
There are two kinds of certificate:
- For a specific experience. Bought from an experience page. The certificate names that experience and the number of people it was bought for. Its face value is the price of that experience for that number of people, including any GST.
- Your choice. Bought from the gift-certificate page for an amount you pick. Its face value is that amount, and the holder chooses any experience on feelit.ca.
Conditions of every certificate. These are printed on the certificate itself and repeated here:
- Issued by 2828468 ALBERTA INC., operating as FeelIt.
- Redeemable only at feelit.ca. Operators do not accept or redeem certificates.
- Not redeemable for cash and cannot be used to make a payment on a credit account.
- This certificate does not expire. The remaining value stays on it until it is used, however long that takes.
- Remaining value can be checked at any time at feelit.ca/activate or by emailing [email protected].
- Refunds and changes: see our Refund Policy.
- A certificate for a specific experience covers that experience, for the number of people it was bought for, at its face value; a different experience is priced when you redeem.
How a certificate is used. The holder goes to feelit.ca/activate, enters the certificate code and their province, chooses the experience and the number of people, accepts the participant release for that experience (section 7), chooses the date, and confirms. Then:
- The suggested experience redeems at face value. If the holder chooses the experience named on the certificate for the number of people it was bought for, the certificate covers it in full, whatever that experience costs on the day.
- A different experience, or a different number of people, is priced when you redeem — at the price shown on feelit.ca at that moment, including any GST. If that price is higher than the remaining value, the holder pays the difference by card before the date is confirmed. If it is lower, the rest stays on the certificate as remaining value for another experience.
- Remaining value is never reduced by a fee, can never be increased by a payment, and cannot be moved to another certificate or another person. A certificate can be used more than once until its remaining value is used up.
- If the experience named on a certificate is not available when the holder comes to redeem it, the holder may choose another experience, or write to us for a replacement or a refund under section 6.
Delivery. Certificates are delivered electronically, by email, to the recipient address the buyer gives us. Nothing is shipped. The certificate is issued as soon as payment is confirmed; the buyer decides when it is sent on to the recipient and can correct the recipient’s email address before sending.
The certificate code (in the form FEEL-XXXX-XXXX) is how the certificate is used: it is what the holder enters at feelit.ca/activate to see the remaining value, activate the certificate and redeem it. Keep the code confidential: we may honour the first use of a code without further identity checks. Looking up a code never shows the buyer’s or the holder’s email address.
Your account. You can buy as a guest — we create an account for your email address so you can manage your orders. You sign in through secure links we email you, or set a password in your account. Keep your sign-in details confidential.
3. Operators
Every experience is conducted by an operator: an independent business that FeelIt selects, that holds its own licences and its own insurance, and that runs the aircraft, venue, range, stable or workshop where the experience happens. The operator conducts the experience and is responsible for safety on site. The operator gives the briefing, provides the equipment and staff, and applies its own rules on the day.
Before an operator’s experiences go on sale, and for as long as they stay on sale, we hold evidence that FeelIt is an additional insured on that operator’s liability policy and its workers’ compensation clearance, and we have agreed with it the capacity it makes available to us. An experience comes off sale when either document lapses.
FeelIt assigns the operator for your date and may substitute a similarly qualified, insured operator; you will be told before your visit is confirmed. You choose the experience and the date; we choose which operator conducts it. This right to substitute is a condition of purchase. If we change the operator after your date is confirmed, we tell you, and you may keep the date, move it free of charge, or cancel that date — the value goes back onto the certificate, or, for a booking, is refunded.
When the operator is named. Experience pages do not name the operator. For a booking, the operator is named in your confirmation email and in your account. For a certificate, it is named when the holder confirms the date at feelit.ca/activate. Operators never receive your certificate: they receive an assignment from us — the experience, the date and time, the number of people and the first name of the person attending.
Who to contact. For the certificate, your payment, a change of date, a refund, or anything that stays unresolved — FeelIt. For what to bring, where to meet and what happens on the day — the operator, once it has been named. An operator may offer optional extras on site, such as photographs; those are optional, are the operator’s own sale, and are paid to the operator.
4. Prices, payment and tax
- All prices are in Canadian dollars (CAD). FeelIt sets its own prices.
- Payments are processed by Stripe on its own secure payment page. We never see or store your card number.
- FeelIt adds no charge of its own to the price shown. There is no booking fee, no service fee, and no fee for issuing, sending, activating, changing or holding a certificate. Certificates are digital, so there is nothing to pay for packaging or delivery. Apart from any GST that applies, the price you see is the price you pay.
- GST. Whether GST is charged depends on whether FeelIt is registered for GST/HST. FeelIt is not currently registered for GST/HST, so no GST is charged, and the checkout says so. Once FeelIt is registered, the rules are these: a booking shows GST as a separate line before you pay and on your receipt; a certificate carries no separate tax when it is bought, because its face value is a tax-inclusive amount — the GST is accounted for when the certificate is redeemed, inside the price of the experience, and the redemption email states the GST included; a difference paid by card includes GST, shown on its receipt. Either way, the checkout shows the tax line that applies — or states that no GST is charged — before you pay.
- You receive an emailed receipt at the time of sale. It repeats the main terms of your purchase — keep it.
5. Bookings, changes and no-shows
A booking is made at checkout against the times published for the experience. A certificate’s date is fixed at feelit.ca/activate when the holder redeems it. In both cases the seats are held from that moment, and dates can be chosen up to a year ahead.
FeelIt never charges a fee for a change or for a certificate; a late change may be declined, not priced.
- At least 48 hours before the start time, a date can be moved to any other available time for the same experience, free of charge. A certificate holder does this at feelit.ca/activate with the certificate code and confirms the new date the same way as the first. If you booked for yourself, email [email protected] and we move it for you.
- At least 48 hours before the start time, a certificate holder can also cancel the date altogether: the seats are released, the value used for that date goes back onto the certificate as remaining value, and any difference paid by card for that date is refunded to that card.
- Less than 48 hours before the start time, the operator’s staff and equipment are already committed. Write to us and FeelIt decides case by case whether the date can still be moved or cancelled. A late change may be declined; it is never charged for.
- No-shows. If nobody attends the booked time and the date was not moved or cancelled in time, the experience counts as delivered: a booking is not refunded, and the value used for that date is not restored to the certificate. Your statutory rights (section 8) are unaffected.
- If someone in your party is turned away for not meeting a requirement that was stated before you bought — age, health, weight, ID — tell us. We offer another date where the operator can, and FeelIt decides case by case whether the value is restored. Your statutory rights are unaffected.
By activating or redeeming a certificate at feelit.ca, the holder agrees to these Terms. A person who takes part without having used feelit.ca is not bound by them; that person signs the operator’s own release on site (section 7).
6. If the operator cannot deliver
If the operator cannot deliver, we will offer a comparable replacement; you may instead cancel and we refund the full amount within 15 days.
This covers every case where the experience does not happen for a reason on the operator’s side or ours: the operator cancels, weather or safety stops the activity, the operator closes or stops working with FeelIt, the experience is withdrawn from sale, or no operator can be assigned for your date. We tell you as soon as we know, and you tell us which you want. The full amount means everything paid for the booking, or, for a certificate, the value applied to that date, any difference paid by card, and the remaining value. If you would rather keep the certificate for another time, the value applied to the date goes back onto it instead, and any difference paid by card is refunded to that card. The details are in our Refund Policy.
7. Participant release
Some experiences involve inherent physical risk — flying, shooting sports, riding, climbing. Before paying — for a booking or for a certificate — and again before a certificate is activated, the person doing so reads and accepts the FeelIt Participant Release. The full text is shown at each of those points, with its version, and it forms part of your contract with us. A copy is emailed to the person who accepted it.
- The release asks for four separate acknowledgements, none of them pre-checked: that the experience carries a risk of serious injury; that you release claims, including claims for negligence; that the released parties include FeelIt and the operator conducting the experience; and that you are 18 or older and accept for yourself.
- The release applies to the person accepting it and is not tied to a date: it covers the experience however the date is later moved.
- Other adults in your party sign the operator’s own release on site before taking part. Our agreement with operators requires that on-site release to name FeelIt as a released party.
- Only adults accept online. Where an experience admits participants under 18, the operator’s own parental consent process applies on site.
Read the release before you buy. Taking part depends on accepting it, and the operator will not admit anyone who has not signed. The release does not limit the rights described in sections 8 and 10.
8. Your statutory cancellation rights
Alberta’s Internet Sales Contract Regulation applies to our online sales over $50, because we are an Alberta supplier. It gives consumers cancellation rights in certain circumstances — for example, if required pre-purchase information was not disclosed, or a copy of the contract was not provided within 15 days.
- If the experience does not begin when it should, you can cancel at any time before it begins and we return everything you paid. Where no date was set — and a certificate on which no date has yet been fixed is exactly that case — the Regulation gives you that right once 30 days have passed since your purchase, so waiting because you choose to costs you nothing. Where a date was set, we honour the same right from that date, without asking you to wait out any further period.
- You can give us a cancellation notice in any way and by any means: the law does not require a particular form, a particular address or a particular channel. Email or post reach us fastest. Unless you hand it to us in person, the notice counts from the moment you send it.
- Where a statutory cancellation right is exercised, we refund all consideration paid within 15 days of the cancellation, as the Regulation requires — including amounts you paid to someone else in connection with the purchase. That 15-day deadline is the one the Regulation sets, and we apply it to any statutory cancellation, whatever the purchase price.
- If you live outside Alberta, the consumer protection law of your own province may give you further rights. Those rights apply whether or not you invoke them; tell us and we will act on them. Nothing here replaces them.
9. Where we sell
FeelIt sells to people in Canada. FeelIt currently sells and honours certificates only outside Quebec. At checkout, and again when a certificate is activated, we ask for a province and a postal code; where either is in Quebec, the purchase or the activation does not go through, and the screen says so. Each experience page says where the experience takes place; where that is Alberta, the redemption of a certificate for it is governed by Alberta law. A person who receives a gift certificate is a consumer in their own right, with the rights described in these Terms and in our Refund Policy.
10. Our responsibility to you
We stand behind what we sell. The certificate is our own obligation; the payment, the issuing and activation of certificates, the assignment of an insured operator, and the replacement or refund under section 6 are ours to deliver. The operator conducts the experience and is responsible for safety on site.
To the maximum extent permitted by applicable law, FeelIt’s total liability in connection with a purchase is limited to the amount paid to FeelIt for that purchase, by whoever paid it. That limit does not apply to death or personal injury, to our gross negligence or wilful misconduct, or to any liability that the law does not allow us to limit.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Consumer Protection Act (Alberta), under the consumer protection law of your province of residence or any other applicable consumer protection legislation, or any liability that cannot be excluded or limited under applicable law. Any attempt to do so has no effect.
11. Content, reviews and intellectual property
If you post a review or other content, it must reflect your genuine experience. Disclose any material connection to the operator — for example, if you work for it, are related to someone who does, or received a discount in exchange for the review. You grant FeelIt a non-exclusive licence to display the content on feelit.ca. We publish reviews as their authors wrote them. We do not edit, shorten or rephrase a review without the author’s written permission. We remove content that is unlawful, fake, or unrelated to a real purchase — we do not remove a review because it is critical of an operator or of us.
The FeelIt word mark and logo are used as our trademarks — see the notice in section 1 — and the material we produce for the site is ours. Photographs and descriptions of an experience come from the operator, which grants us a written licence to them and warrants that it holds the rights it licenses. Nothing on the site may be copied for commercial use without permission. Do not make fraudulent purchases, misuse certificate codes, scrape or resell the site, or interfere with its operation or security.
Copyright complaints. If you believe material on feelit.ca infringes your copyright, email [email protected] with the subject line Copyright concern. Under section 41.25(2) of the Copyright Act, your notice has to be in writing and state your name and address; the work you say is infringed; your interest or right in it; the exact location of the material on our site (a link); what the alleged infringement is; the date and time of it; and anything else the regulations require. It must not contain an offer to settle, a request or demand for payment or for personal information, or any reference to one, including a link — the Act forbids it. When we get a notice that meets those requirements, we forward it to whoever supplied the material as soon as feasible, tell you that we have done so — or why it was not possible — and keep the records that would allow that person to be identified. Canada’s regime is notice-and-notice: it does not require material to be taken down on receipt of a notice, so we do not promise removal. We may remove material that breaks these Terms or that a court tells us to remove.
12. Privacy
How we handle personal information — including the recipient’s details a buyer shares with us and the record of the participant release — is described in our Privacy Policy.
13. Governing law and where disputes go
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta. Disputes may be brought before the courts of Alberta, subject to any right you may have under applicable consumer protection law to bring proceedings in another forum — for instance, in the province where you live.
These Terms contain no arbitration clause. We are not asking you to give up going to court, and we are not sending you to a private process that would cost you more than the purchase.
14. Changes to these Terms
We may update these Terms from time to time. The date and version at the top of this page identify the current text.
- The terms of your purchase are fixed on the day you buy. What you bought, what you paid, and how it can be changed or refunded are governed by the version in force that day, and a later change never takes anything away from them. Where a later version gives you more than the version in force that day, the later version applies.
- A material change to how feelit.ca is used takes effect no earlier than 30 days after it is posted here, and we will email certificate holders before it takes effect.
- We keep previous versions of these Terms. Ask us and we will send you the version in force on the day of your purchase, from the history we keep.
- Our Refund Policy forms part of these Terms, so this section applies to changes in it in exactly the same way.
